Acceptance of these Terms of Use

By using Guts Church sites, services, products and mobile applications (together, “Guts Church Sites”), whether as a guest or a registered user, you accept and agree to be bound by these Terms of Use. Please read these Terms of Use carefully before you start to use Guts Church Sites, as well as the Guts Church Privacy Policy (available on our website). If you do not agree to these Terms of Use or the Guts Church Privacy Policy you must not access or use the Guts Church Sites.

Changes to the Terms of Use

Guts Church, Inc. (also referred to herein as “Guts”, “Church”, “our”, “us”, or “we”) may revise and update these Terms of Use from time to time at our sole discretion. Any changes are effective when we post them. Your continued use of a Guts Church Site following the posting of revised Terms of Use by us means that you accept and agree to the changes.

Information About You and Your Access of Guts Church Sites

All information we collect is subject to our Privacy Policy. By using Guts Church Sites, you consent to all actions taken by us in compliance with the Privacy Policy.

Permitted and Unpermitted Use

You may use Guts Church Sites in accordance with these Terms of Use for either your personal and non-commercial use. All rights not expressly granted to you are reserved by Guts Church. You agree you are not permitted and will not use Guts Church Sites as follows:

  • in any way that violates any federal, state, local or international law or regulation;
  • for the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise;
  • to impersonate or attempt to impersonate any company or person, including Guts Church or;
  • to engage in any other conduct which, as determined by us, may harm Guts Church or others;
  • in any manner that could disable, overburden, damage, or impair Guts Church Sites, or interfere with any other person’s use of the same;
  • use any robot, spider or other automatic device, process or means to access Guts Church Sites for any purpose, including monitoring or copying any of the material on Guts Church Sites;
  • to introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;
  • to attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of Guts Church Sites or any server, computer or database connected to Guts Church Sites;
  • to attack Guts Church Sites via a denial-of-service attack or a distributed denial-of-service attack; and
  • otherwise attempt to interfere with the proper working of Guts Church Sites.

You also agree that you will not send, knowingly receive, upload, download, use or re-use any material which:

  • contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
  • promotes sexually explicit or pornographic material, violence, or discrimination on any basis, including that based on race, sex, religion, nationality, disability, or age;
  • infringes any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person;
  • violates the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under laws or regulations; 
  • promotes any illegal activity, or advocates, promotes or assists any unlawful act;
  • involves commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising; and/or
  • gives the impression that the material emanates from or is endorsed by Guts Church or any other person or entity, if this is not the case.

Account Security

We allow users to create an account on certain sites which require providing certain information to Guts Church. If you choose, or are provided with, a user name, password, or similar information as part of our security procedures, you agree to treat such information as confidential, and agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms of Use.

Monitoring and Enforcement; Legal Compliance; Termination

You agree that we have the right to:

  • take any action with respect to any user or account that we deem necessary or appropriate in our sole discretion if we believe there to be a violation of these Terms of Use, infringement of third-party rights, a threat to the personal safety of others, or a threat or liability or harm to the goodwill associated with Guts Church or Guts Church Sites;
  • take appropriate action, including without limitation, referral to law enforcement and disclosure of your information, for any illegal or unauthorized use of Guts Church Sites; and/or
  • terminate or suspend your access to all or part of Guts Church Sites for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through Guts Church Sites. YOU WAIVE AND HOLD HARMLESS GUTS CHURCH AND ITS LICENSEES AND SERVICE PROVIDERS AND ALL OF THEIR EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, OFFICERS, AND DIRECTORS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF LEGAL INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER GUTS CHURCH OR LAW ENFORCEMENT AUTHORITIES.

Your Reliance on Information

The information presented on or through Guts Church Sites is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to Guts Church Sites, or by anyone who may be informed of any of its contents.

Intellectual Property Rights

Guts Church Sites and their contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement of the same), are owned by Guts Church, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Logos and Designs

The Guts Church name and logo and all related names, logos, product and service names, designs and slogans are trademarks and/or copyright of Guts Church. You must not use these marks and copyright without the prior written permission of Guts Church. All other names, logos, product and service names, designs and slogans on Guts Church Sites are the trademarks of their respective owners.

Copyright Infringement

If you believe that any content provided on any Guts Church Sites violates your copyright or other rights, please contact our designated agent by: (a) mail at ATTN: Guts Church Legal Department, 9120 E. Broken Arrow Expy; Tulsa, Oklahoma 74145; (b) phone at 918-622-4422; or (c) electronic mail at info@gutschurch.com. Please be aware that it is the policy of Guts Church to terminate the user accounts of repeat infringers.

Third Party Links and Services

Guts Church may include content provided by third parties. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to Guts Church, you do so entirely at your own risk and subject to the terms and conditions of use for such websites. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by Guts Church, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of Guts Church. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

Geographic Restrictions

Guts Church is based in the state of Oklahoma in the United States. We make no claims that Guts Church Sites or any of its content are accessible or appropriate outside of the United States. Access to Guts Church Sites may not be legal by certain persons or in certain countries. If you access Guts Church Sites from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Participation in the Guts Church School of Online Ministry

The Guts Church School of Online Ministry (“GutsX”) provides users with access to a large collection of various online resources, which includes or may include in the future, text, audio, and video services. Unless explicitly stated otherwise, any new features that expand or enhance the current service, including the release of new content and/or new pricing models, shall be subject to the Guts Church Privacy Policy and this Privacy Policy. Registration data and certain other information about you is subject to our Guts Church Privacy Policy which, together with any modifications or amendments thereto, is incorporated herein by this reference. For more information, please see our full Privacy policy. You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes any portion, use of, or access to GutsX, including any online content. Guts Church makes no warranties, express or implied, as to the accuracy, reliability, or benefits of any content on GutsX, including any improvement in a user’s ability to achieve user’s ministry/church related goals or aspirations, or the accuracy and reliability of any Messages and other materials in the Guts X Forums.  

GutsX utilizes a third-party application/provider to process payments for GutsX content and subscription services. Your correspondence and business dealings with the third-party payment processor, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such party. You agree that neither Guts Church, GutsX (including their respective employees, contractors, representatives, agents, officers, and directors) shall be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third-party providers. 

Certain features of GutsX may require you to register personal information and obtain a user name and password. You are responsible for all uses of your account, whether or not actually or expressly authorized by you. Guts Church grants you a non-exclusive, non-transferable license to create an account for and use GutsX subscription content in accordance with this Terms of Use agreement and the terms of your subscription. Your subscription purchase entitles you to utilize the online content purchased by you for your own use during the term in which you have purchased access (e.g., 1-year subscription). Under no circumstances are GutsX digital products/services purchased by you to be shared with others. Guts Church reserves the right to immediately terminate access to GutsX content in the event of late or non-payment. 

GutsX Community Boards/Interactive Communications

The Guts Church School of Online Ministry (“GutsX”) reserves the right to provide a forum for online dialogue and discussion for and among GutsX users. All interactive communications (email, chat, commenting, discussion boards, etc.) are subject to public access. 

All interactive communications (email, chat, commenting, discussion boards, etc.) are subject to public access. Although we reserve the right to remove without notice any bulletin board posting for any reason, we have no obligation to delete content that you may find objectionable or offensive. Information and opinions expressed in discussions or other interactive communications are not necessarily those of Guts Church or GutsX. Users alone are responsible for the contents of the messages they communicate when using our services as well as the consequences of any such messages.

You are welcome to post, transmit, or submit messages and other materials (collectively “Messages“) to bulletin boards, chat rooms or other public areas within, or in connection with Guts Church Sites, including GutsX related sites, (collectively “Forums“). However, Guts Church accepts no responsibility whatsoever in connection with or arising from such Messages. In addition, children under the age of 18 are not authorized to post Messages or participate in Forums on any GutsX related site. Guts Church Sites, including GutsX sites, do not collect personal information from any person we know is under 18 without consent of that minor’s parent or guardian.  Guts Church Sites do not knowingly solicit data from or market to children under eighteen (18) years of age. By using GutsX products or services, or participating in any GutsX Forums, you represent that you are at least eighteen (18) or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Guts Church Sites. 

Guts Church does not endorse and has no control over the content of Messages submitted by others to Forums. Messages submitted to Forums are not necessarily reviewed by Guts Church prior to posting and do not necessarily reflect the opinions or policies of Guts Church. Guts Church makes no warranties, express or implied, as to the content of the messages in the Forums or the accuracy and reliability of any Messages and other materials in the Forums. Nonetheless, Guts Church reserves the right to prevent you from submitting materials to Forums and to edit, restrict, or remove such messages for any reason at any time.

Guts Church assumes no responsibility for actively monitoring Forums for inappropriate messages. If at any time Guts Church chooses, in its sole discretion, to monitor the Forums, Guts Church nonetheless assumes no responsibility for the content of the Messages, no obligation to modify or remove any inappropriate Messages, and no responsibility for the conduct of the user submitting any message. In submitting Messages to Forums, you agree to strictly limit yourself to discussions about the subject matter for which the Forums are intended. You agree that Guts Church accepts no liability whatsoever if it determines to prevent your Messages from being submitted or if it edits, restricts or removes your Messages. 

You agree that you will not submit Messages to Forums that:

  • Are unlawful, threatening, obscene, vulgar, pornographic, profane, or indecent including any communication that constitutes (or encourages conduct that would constitute) a criminal offense, gives rise to civil liability or otherwise violates any local, state, national or international law;
  • Violate the copyright, trademark or other intellectual property rights of any other person. By submitting Messages to Forums, you represent to Guts Church that you are the rightful owner of such material or that you have first obtained permission to submit the material from the rightful owner;
  • Improperly assume or claim the identity, characteristics, or qualifications of another person
  • Are for purposes of spamming
  • Contain any virus or other harmful component
  • Are libelous, or an invasion of privacy or publicity rights or any other third-party rights; or
  • Are for commercial purposes or contain advertising or are intended to solicit a person to buy or sell services or to make donations.

Guts Church reserves the right to edit, restrict, or remove such Messages for any reason at any time. You agree that any Message whatsoever submitted by you becomes the property of Guts Church and may be used, copied, sublicensed, adapted, transmitted, distributed, publicly performed, published, displayed, or deleted as Guts Church sees fit. You agree to release Guts Church together with their respective employees, contractors, agents, representatives, officers, and directors, from any and all liability and obligations whatsoever in connection with or arising from your use of Forums. If at any time you are not happy with the Forums or object to any material within Forums, your sole remedy is to cease using them.

Disclaimer of Warranties

YOUR USE OF ANY GUTS CHURCH SITE, ITS CONTENT AND ANY FUNCTIONALITY, SERVICES OR ITEMS OBTAINED THROUGH GUTS CHURCH SITES IS AT YOUR OWN RISK, ALL OF WHICH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER GUTS CHURCH NOR ANY PERSON ASSOCIATED WITH GUTS CHURCH MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF GUTS CHURCH SITES. WITHOUT LIMITING THE FOREGOING, NEITHER GUTS CHURCH NOR ANYONE ASSOCIATED WITH GUTS CHURCH REPRESENTS OR WARRANTS THAT GUTS CHURCH OR ANY FUNCTIONALITY, CONTENT, OR ANY PRODUCTS, SERVICES, OR ITEMS OBTAINED THROUGH GUTS CHURCH SITES WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT GUTS CHURCH SITES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE GUTS CHURCH SITES OR ANY PRODUCTS, SERVICES, OR ITEMS OBTAINED THROUGH THE GUTS CHURCH SITES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

GUTS CHURCH HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

IN NO EVENT WILL GUTS CHURCH, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, ANY GUTS CHURCH SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT OFFERED ON OR THROUGH THE GUTS CHURCH SITES OR SUCH OTHER WEBSITES OR ANY PRODUCTS, SERVICES, OR ITEMS OBTAINED THROUGH THE GUTS CHURCH SITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE USE OF GUTS CHURCH OR GUTSX SITES, ANY RELATED PRODUCT OR SERVICE, OR OUR PRIVICY POLICY OR THIS TERMS OF USE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED. 

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify and hold harmless Guts Church, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of Guts Church Sites, including, but not limited to, any use of Guts Church content, products, and services other than as expressly authorized in these Terms of Use or your use of any information obtained from Guts Church Sites.

Governing Law and Jurisdiction

All matters, disputes, or claims relating to Guts Church Sites and these Terms of Use (including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Oklahoma without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of, or related to, these Terms of Use shall be instituted exclusively in the federal courts of the United States or the courts of the State of Oklahoma in each case located in the City of Tulsa, Oklahoma County. By agreeing to these Terms of Use and using Guts Church Sites, you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

Guts Church may only waive its rights under these Terms of Use in writing. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Use will continue in full force and effect.

Entire Agreement

These Terms of Use and our Guts Church Privacy Policy constitute the sole and entire agreement between you and Guts Church, Inc., with respect to Guts Church Sites and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to Guts Church Sites.

Your Comments and Concerns

Guts Church Sites are operated by Guts Church, Inc., an Oklahoma Corporation. The God-ordained, creative authority given to every believer is examined in Scripture. Doctrine of the Word

Each student must know that the Bible was written for them—they need not rely on scholars and teachers to interpret it. Jesus stated that after His departure that Another Comforter, Holy Spirit would come and that Holy Spirit would teach us all things, bring truth to our remembrance, guide us into applications of truth discovered.  We don’t devalue working in community with other believers and their insight, but we must not ignore our divine source of truth.  2 Timothy 2;15 “Study to show thyself approved unto God, a workman who needs not to be ashamed, rightly dividing the word of truth.” As ministers of God, we have a great responsibility to communicate God’s truth by having insight into the types, tools, and techniques of personal study, accurately handling the word of truth”.

This course is a study of God’s revelation of righteousness to the Church. The message of righteousness runs throughout the Bible; from the creation of man to the Second Coming of Jesus Christ. Righteousness is one of the most important messages ever offered to the believer.

Gifts of the Spirit

“There are varieties of spiritual gifts, but it is the same Spirit….To each one is given the manifestation of the Spirit for the common good (1 Cor. 12:4,7 AMP).  This course is the study of the gifts of the Holy Spirit, imparted through the grace of God for the edification of the body. In this course, you will gain a deeper understanding of each of the nine spiritual gifts (wisdom, knowledge, faith, healing, miracles, prophecy, discerning of spirits, speaking in tongues, and interpretation of tongues) and discover your personal giftings and how their manifestation brings glory to God and empowers His people.

In this course Jesus is our ultimate example of praying with power and authority. This course teaches you biblical instruction and types of prayer, how to pray effectual and fervent prayers, and the creative power of praying God’s promises.  In addition, this course will include practice and application

Five Fold Ministry Gifts 

In this course you will study and identify the governing gifts of ministry leadership in both the global and local church as outlined in Ephesians 4. Those gifted in the office of five-fold ministry: apostle, prophet, evangelist, pastor and teacher- are specifically anointed to advance the Kingdom by equipping believers for the work of the ministry, build and edify believers in both knowledge and maturity, and create unity within the body of Christ. For the body of Christ to function properly, each member has a role to play and unique gifts given by the Holy Spirit (Rom. 12; 1 Cor. 12). In this course you will learn how the five-fold ministry is to equip the saints so they can function in their gifts.
